Safi Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Safi mobile application and related services (collectively, the "Service").
By creating an account, checking the acceptance box, or using Safi, you agree to these Terms and our Privacy Policy.
Privacy Policy:
If you do not agree, do not use Safi.
1. Who We Are
Safi is provided by Turki Alenezi ("Safi", "we", "our", or "us").

2. Eligibility
To use Safi, you must:
- Be at least 18 years old.
- Have legal capacity to enter into a binding agreement.
- Provide accurate registration information.
You represent and warrant that your date of birth and other account details are accurate.
3. Account Registration and Security
You are responsible for:
- Keeping your login credentials confidential.
- All activity under your account.
- Promptly notifying us of unauthorized access or suspected compromise.
- Keeping your account information reasonably accurate and up to date.
You must not share your account with another person.
4. Service Description
Safi is a driver operations and analytics tool. Depending on your usage, Safi supports:
- Shift tracking and timing.
- Trip logging.
- Income and expense tracking.
- Vehicle-related cost estimation.
- Reports and insights.
Safi is not a transportation network, booking platform, dispatch service, employer, payroll provider, tax advisor, legal advisor, or accounting firm.
Reports, estimates, cost calculations, and analytics are provided for informational purposes only and are not financial, tax, legal, accounting, employment, or other professional advice. Safi is not an emergency service and must not be relied on for emergency communications, dispatch, or urgent response.
5. Data Accuracy and User Responsibility
Safi relies on information you provide and device signals you allow.
You are responsible for:
- Entering correct trip, income, expense, and vehicle data.
- Reviewing generated reports before using them for financial or operational decisions.
- Using the app in a lawful and safe manner.
- Obtaining independent professional advice when needed for legal, tax, financial, accounting, or employment matters.
Estimated outputs (including costs, distance, and analytics) may vary from real-world outcomes.
6. Permissions and Device Settings
Some features require device permissions, including:
- Location and background location for active shift tracking.
- Notifications for app-related alerts.
Where supported and enabled, background location is used to support active shift tracking sessions. If permissions are denied or revoked, some features may be unavailable or degraded.
7. Acceptable Use
You must not:
- Use Safi for unlawful, fraudulent, abusive, or deceptive activity.
- Attempt unauthorized access to Safi systems or user data.
- Interfere with app stability, security, or network operations.
- Reverse engineer, decompile, or tamper with the Service except where law expressly permits.
- Use bots, scripts, or automation to abuse the Service.
8. Driving Safety
Safi is intended to support drivers with tracking, logging, and analytics. It must not be used in a way that distracts from safe driving.
You are responsible for:
- Following all traffic, road safety, and device-use laws.
- Using Safi only when it is safe and lawful to do so.
- Avoiding interaction with the app while driving if it may cause distraction.
- Delaying app interaction until safely stopped and parked where interaction while moving is unsafe or unlawful.
- Complying with the rules of any rideshare, delivery, or transportation platform you use.
To the maximum extent permitted by applicable law, Safi is not liable for accidents, traffic violations, penalties, platform disputes, or losses arising from unsafe, distracted, or unlawful use of the Service. Nothing in this section limits liability that cannot be excluded under applicable law.
9. Third-Party Services
Safi depends on third-party providers for infrastructure and technical delivery (for example authentication, hosting, notifications, and maps).
Third-party services are governed by their own terms and policies. We are not responsible for outages or failures caused by third-party providers.
10. Intellectual Property
All rights in the Service, including software, design, text, trademarks, logos, and related content (excluding user-provided content), are owned by Safi or its licensors.
These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.
No ownership rights are transferred to you.
11. Your Content and License to Operate
You retain ownership of data you submit to Safi (for example shift/trip records, notes, and profile inputs).
You grant Safi a limited license to host, process, transmit, and store that data solely to:
- Operate and secure the Service.
- Provide requested features.
- Maintain reliability and prevent abuse.
- Comply with applicable law.
If you submit suggestions, ideas, or feedback about Safi, you grant Safi a non-exclusive, worldwide, royalty-free license to use and incorporate that feedback to improve the Service without compensation to you.
12. Privacy and Data Handling
Our Privacy Policy explains how we collect, use, retain, delete, and protect data.
By using Safi, you acknowledge the Privacy Policy and consent to the described processing where consent is the legal basis.
13. Account Deletion
You can request account deletion in-app from: More → Profile → Delete account
You can also view account deletion instructions or request deletion support at: https://safi.anaports.com/delete-account.html
Current Safi deletion flow is permanent account deletion, not temporary deactivation.
When deletion is requested:
- User-linked production records are deleted from active production systems, except for limited records retained where required or permitted by law.
- Authentication account is deleted.
- A minimal technical deletion audit record may be retained for a limited period for security and operational verification, without storing raw name, raw email, or raw phone.
- Examples of limited retained records may include records needed for security, fraud prevention, dispute handling, legal compliance, or technical verification.
- If encrypted backups are enabled in the infrastructure, deletion from backups follows backup lifecycle timing.
- On successful deletion, Safi may provide a deletion reference identifier for operational follow-up.
14. Paid Features and Billing
As of the Last Updated date, Safi does not require paid membership or subscription billing to use current core features.
If paid plans, subscriptions, or in-app purchases are introduced later:
- Additional pricing and billing terms may apply.
- Platform billing rules (Apple App Store / Google Play) may apply where relevant.
- Taxes and fees, if applicable, will be disclosed before purchase.
15. No Warranty
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or always available.
- Any report, metric, or estimate will be complete, accurate, or suitable for your specific use case.
Nothing in these Terms limits non-waivable rights under applicable consumer law.
16. Limitation of Liability
To the maximum extent permitted by law:
- Safi and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption.
- Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of: (a) the amount you paid us for the Service in the 12 months before the claim, or (b) SAR 200.
This limitation does not apply where liability cannot be excluded or limited by law (for example, willful misconduct, gross negligence, or other non-excludable rights under applicable law).
17. Indemnity
You agree to defend, indemnify, and hold harmless Safi and its affiliates, officers, employees, and agents from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your misuse of the Service.
- Your breach of these Terms.
- Your violation of law or third-party rights.
18. Suspension and Termination
We may suspend or terminate access to the Service, with or without notice, if:
- You materially or repeatedly breach these Terms.
- Needed to protect users, Safi systems, or legal compliance.
You may stop using the Service at any time and may request account deletion through the in-app flow.
Sections that by nature should survive termination remain effective, including sections on IP, disclaimers, liability limits, indemnity, and dispute terms.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia, unless mandatory law in your jurisdiction requires otherwise.
Before filing a formal claim, both parties agree to attempt good-faith resolution by contacting the other party first.
Subject to mandatory consumer law, disputes will be submitted to the competent courts of Riyadh, Saudi Arabia.
20. Force Majeure
Safi is not liable for delay or failure caused by events beyond reasonable control, including infrastructure outages, internet failures, natural disasters, government actions, war, cyberattacks, labor disruptions, or utility interruptions.
21. Changes to the Service
We may update, modify, suspend, or discontinue any part of the Service at any time, including adding, changing, or removing features.
Where reasonably required, we will provide notice of material changes.
22. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we may provide additional notice in-app or by other reasonable means. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.
23. Platform-Specific Terms
Apple App Store
If you downloaded Safi from the Apple App Store:
- These Terms are between you and Safi, not Apple.
- Apple has no obligation to provide maintenance or support for Safi.
- To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to Safi. If Safi fails to conform to an applicable warranty and you paid a purchase price through Apple, you may notify Apple, and Apple may refund that purchase price (if any) to you.
- Apple is not responsible for addressing any claims by you or any third party relating to Safi, including product liability claims, legal or regulatory claims, consumer protection claims, or claims that Safi fails to conform to applicable legal or regulatory requirements.
- Apple is not responsible for any third-party intellectual property claims relating to Safi or your possession and use of Safi.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play
If you downloaded Safi from Google Play:
- These Terms are between you and Safi, not Google.
- Google has no obligation to provide maintenance or support for Safi.
- Google is not responsible for addressing any claims by you or any third party relating to Safi.
- Google is not responsible for any third-party intellectual property claims relating to Safi or your possession and use of Safi.
- You must also comply with Google Play terms that apply to your use of apps and services.
24. Export and Sanctions Compliance
You represent that you are not located in, under control of, or resident of any country or territory subject to comprehensive trade sanctions applicable to your use of the Service, and you are not listed on any prohibited or restricted party list applicable to such use.
25. Severability, Waiver, and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
Failure by Safi to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with the Privacy Policy, are the entire agreement between you and Safi regarding the Service.
26. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
27. Language
These Terms may be provided in more than one language.
In case of conflict between versions, English version governs, to the extent permitted by law.
